Consent & Agreement — Cannabox MD

1. Purpose of This Consent

This Consent & Agreement authorises Cannabox MD, licensed practitioners, partner clinics, and dispensaries to:

• Verify your identity and medical eligibility,
• Provide telemedicine consultations,
• Issue medical documents (including PorThor 33),
• Dispense controlled herbs (cannabis) in compliance with Thai law,
• Collect and process personal and medical information for regulatory and clinical purposes.

You must read and accept this Consent before continuing.

2. Telemedicine Consent

By continuing, you acknowledge and agree that:

• Telemedicine has limitations and may not replace in-person medical evaluation.
• The practitioner may request additional information, documentation, or terminate the session if insufficient data is provided.
• Physical examination may be limited or not possible.
• You understand the risks of miscommunication or technical issues in remote care.
• You are responsible for providing complete, accurate, and truthful medical information.
• Telemedicine through Cannabox MD is not suitable for emergencies.

3. Identity Verification & Legal Compliance

You consent to:

• Identity verification via ID/passport upload, selfie, or live video.
• Validation of your age (20+) or special patient eligibility under Thai law.
• Verification checks with partner clinics, dispensaries, or authorities where required.

Providing false information invalidates all consultations and prescriptions.

4. Consent to Audio, Video & Evidence Recording

(Required under DTAM Telemedicine Draft, Clause 8(3))

You explicitly consent to the capture, recording, and secure retention of:

• Video or audio during consultation or ID verification,
• Still images (e.g., ID / face match),
• System logs, timestamps, and workflow steps,
• Prescription issuance logs (e.g., PorThor 33 creation record).

These recordings are required for medical documentation, clinical audit, and regulatory compliance.

Retention follows the timelines disclosed in the Privacy Policy.

5. Controlled Herb (Cannabis) Consent

You acknowledge and agree that:

• Cannabis is a controlled herb under Thai law, regulated by MoPH.
• Use is solely for medical purposes as prescribed by a licensed practitioner.
• Misuse, resale, transfer, export, or unauthorized possession is illegal.

Cannabis may cause side effects including:

• Drowsiness or impaired judgment
• Anxiety or increased heart rate
• Memory or concentration issues
• Psychiatric symptoms in sensitive individuals

You will:

• Not drive or operate machinery after cannabis use.
• Avoid use during pregnancy or breastfeeding.
• Follow the prescribed dosage exactly.

6. Consent to PDPA-Compliant Data Processing

You consent to the collection, processing, storage, and disclosure of your personal and medical data for:

• Telemedicine consultations
• Identity verification
• Prescription issuance
• Regulatory compliance
• Order and delivery coordination
• Fraud prevention and platform security
• Customer support

Your full PDPA rights, retention periods, and data protection measures are described in the Privacy Policy.

You may withdraw consent at any time, except where processing is required by law.

7. Data Sharing Consent

You consent to the sharing of necessary data with:

• Licensed practitioners and partner clinics
• Licensed dispensaries and delivery partners
• Payment providers
• Government authorities (DTAM, MoPH, FDA, PHO) when legally required
• IT vendors operating under PDPA-compliant safeguards

Cannabox does not sell personal data.

8. AI-Assisted Support Consent

Cannabox MD may use automated or AI-assisted tools to:

• Assist with form completion
• Provide general educational content
• Improve service quality

AI tools do not diagnose, prescribe, recommend treatments, or replace clinical judgment.

All medical decisions are made solely by licensed practitioners.

9. User Responsibilities

You agree to:

• Provide accurate and truthful information
• Follow the practitioner's instructions
• Use prescribed cannabis responsibly
• Refrain from illegal or fraudulent conduct
• Keep your login details secure

Failure to comply may result in service suspension or reporting to authorities.

10. Withdrawal of Consent

You may withdraw consent by contacting [email protected], except where data retention is required by law, medical ethics, or regulations (e.g., prescription records, telemedicine evidence logs).

Withdrawing consent may immediately terminate your ability to use Cannabox MD.

11. Declaration & Agreement

By clicking "I Agree", you confirm that:

• You have read and understood this Consent & Agreement.
• You voluntarily consent to telemedicine services and controlled herb regulations.
• You consent to the processing and sharing of your data as described.
• You accept the Terms of Use and Privacy Policy of Cannabox MD.
• You are legally eligible to receive medical cannabis services in Thailand.
