1. Acceptance of Terms

By accessing or using the Cannabox website, mobile app, or related services ("Services"), you agree to these Terms of Use. You confirm that:

• You are 20 years or older, or
• You are a legally eligible medical cannabis patient under Thai law.

If you do not agree, you must discontinue use of the Services.

Cannabox is not a medical provider.

We are a technology platform that facilitates communication between:

• Users and licensed practitioners (for medical consultations), and
• Users and licensed dispensaries (for order fulfillment).

Diagnosis, medical decisions, and prescribing are performed solely by licensed practitioners.

Product supply and delivery are performed solely by licensed dispensaries.

Cannabox does not guarantee availability, suitability, or outcomes of medical or product services.

4. Legal & Regulatory Compliance

You agree to comply with all applicable Thai laws, including:

• Controlled Herbs Act B.E. 2562 (2019),
• Relevant MoPH/DTAM notifications,
• Telemedicine regulations,
• Provincial and national enforcement requirements.

Cannabox may verify your identity, eligibility, or age and may refuse or suspend access to ensure legal compliance.

5. User Responsibilities

You agree to:

• Provide accurate identity, medical, and delivery information.
• Use prescribed cannabis only as directed by the practitioner.
• Not resell, share, transfer, export, or misuse controlled herb products.
• Keep your login credentials secure and notify us of unauthorized use.
• Refrain from fraudulent, abusive, or illegal behavior on the platform.
• Follow practitioner instructions and comply with request for additional information.

Providing false or misleading information may invalidate prescriptions and lead to termination.

6. Telemedicine Consent & Limitations

By using telemedicine services through Cannabox, you acknowledge and consent that:

• Telemedicine has limitations and may not replace in-person care.
• Practitioners may decline or terminate a consultation if information is insufficient.
• Physical examination may be limited or unavailable.
• Emergency or urgent conditions are outside the scope of our Services.
• You must provide complete and truthful information for proper assessment.

For emergencies, call 1669 or seek immediate in-person care.

7. Consent to Audio/Video/Image Recording

To comply with DTAM/MoPH regulations, you consent to the collection and retention of:

• Video/audio during identity verification or consultation,
• Still images (e.g., ID verification),
• System logs and timestamps,

for auditing, regulatory compliance, fraud prevention, and legal verification.

Retention is governed by our Privacy Policy.

8. Prescriptions & Medical Documents

Practitioners may issue or decline:

• PorThor 33 prescriptions,
• Medical certificates,
• Consent forms or treatment notes.

Documents may be verified using secure links or QR codes.

Documents are strictly for the named patient and must not be altered or transferred.

Cannabox may store and provide such documents to authorities where required by law.

9. Orders, Fulfillment & Delivery

Orders are fulfilled exclusively by licensed dispensaries.

You acknowledge that:

• Delivery may require ID verification and hand-to-person receipt.
• Product availability may vary.
• Refunds or substitutions follow Thai consumer law and the dispensary's policies.

Cannabox is not liable for delivery delays, product shortages, or dispensary actions.

10. Health & Safety Disclaimer

Cannabis may cause:

• Drowsiness, dizziness, impaired judgment,
• Increased heart rate or anxiety,
• Interactions with medications,
• Psychiatric effects in sensitive individuals.

Do not drive or operate machinery after consumption. Do not use during pregnancy or breastfeeding. Follow practitioner dosage and guidance.

11. Intellectual Property

All content, software, trademarks, and materials on Cannabox are the property of Cannabox or its licensors.

You may not copy, reproduce, modify, or exploit any content without written permission.

12. Limitation of Liability

To the fullest extent permitted under Thai law, Cannabox is not liable for:

• Medical advice or decisions made by practitioners,
• Product effects or dispensary actions,
• Delivery failures or delays,
• Regulatory enforcement,
• Unauthorized account access resulting from your failure to safeguard credentials.

Cannabox makes no warranties regarding uninterrupted access or error-free operation.

13. Indemnification

You agree to indemnify Cannabox from claims, damages, liabilities, or costs arising from:

• Your breach of these Terms,
• Your misuse of the Services,
• Your violation of applicable laws.

14. Suspension & Termination

Cannabox may suspend or terminate your access for:

• Non-compliance with laws or Terms,
• Fraud, misuse, or safety concerns,
• Requests from regulatory authorities.

15. Changes to Terms

We may revise these Terms to reflect legal, regulatory, or service updates.

Continued use after changes constitutes acceptance.

16. Governing Law

These Terms are governed by Thai law.

Disputes shall be resolved by Thai courts unless mandatory consumer protections specify otherwise.
